Can an employee receive payment in lieu of accrued annual leave? |

Unless an established Australian Workplace Agreement refers to payment in lieu of accrued annual leave this is prohibited.
The NSW Act prohibits any payment being made in place of an employee taking annual leave. An exception to this is where an Australian Workplace Agreement is in place and refers specifically to payment in lieu of annual leave. In these circumstances an employee may apply to forgo a maximum of two weeks accrued annual leave in any period of 12 months.
