Small Business Fair Dismissal Code and Checklist

There are special unfair dismissal arrangements that apply to small businesses.These arrangements simplify the dismissal process for small businesses.

The Small Business Fair Dismissal Code Checklist (the Checklist) has been developed to help small business employers comply with the Code. This tool will assist employers follow the Code’s procedural elements when dismissing an employee and understand when the Code applies.The Checklist should be read in conjunction with the Code.

Register of injuries

Employers are required to keep a register of injuries that is readily accessible in the workplace. The manager of any mine or quarry or the occupier of any factory, workshop, office or shop is responsible for this register of injuries.

Workplace Injury Management and Workers Compensation Act 1998 No 86 & Workers Compensation Act 1987 No 70

Together, these Acts establish a workplace injury management and workers compensation system that assists in securing the health, safety and welfare of workers.

A summary of the Workers Compensation Act must be displayed in every workplace in NSW.
